Lawsuit over alleged unpaid fees between Post Oak Mall owners, City of College Station settled, city confirms

COLLEGE STATION, Texas — A previously filed lawsuit against the City of College Station by CBL & Associates, the company that owns the Post Oak Mall, over previously alleged unpaid upkeep costs has been settled.

The suit alleged that the area previously occupied by a Macy's in the Post Oak Mall had upwards of $41,000 in "common area" costs that were owed to CBL & Associates. The area in question was being eyed as a prospective destination for a new esports facility for Texas A&M.

An area of conflict between both parties was in the matter that the funding could be used to pay for the costs. As a city government, College Station isn't allowed to use public funds to pay a private company, which happened in the case with CBL & Associates. This required another solution to be formulated to tackle the issue of payment.

A statement from a City of College Station representative regarding the news can be found below:

"The City of College Station always intended to satisfy the financial obligation to maintain its property according to the law. The settlement was reached on amicable terms for the amount owed and any future payments, ending any dispute with CBL about the law."

While the terms of the settlement were not disclosed, the case was dismissed on Aug. 1, according to online records.
