Lawsuit filed against City of College Station by Post Oak Mall owners over unpaid maintenance costs

Court documents say the City of College Station owes over $41,000 to CBL & Associates, the company that owns the Post Oak Mall.

COLLEGE STATION, Texas — The City of College Station has been sued by CBL & Associates, the company that owns the Post Oak Mall, over unpaid upkeep costs.

According to the suit, "common area" costs involving the former Macy's building that was eyed as a target for a new esports facility for Texas A&M roughly a year ago have not been paid. The total amount that CBL & Associates say the city owes totals $41,726.81.

The City of College Station has since given a statement of their own in response to the lawsuit. It can be found below:

"Before and after purchasing the former Macy’s site at Post Oak Mall, the City has offered to negotiate a separate agreement with CBL for its share of costs and expenses. CBL has refused to negotiate a separate agreement and has not provided a cost breakdown for maintenance on the City-owned property. 

The City has been prepared to pay its share of maintenance and operation costs related only to the city-owned property. The City is legally barred from paying into private corporations like CBL, the Post Oak Mall owner. The fees associated with operating a mall are used for maintaining the privately owned mall, and the City cannot use public funds for that purpose."
