Death penalty upheld for man sentenced in 2015 for capital murder by Texas Court of Criminal Appeals

In 2011, Gabriel Hall fatally stabbed and shot Edwin Shaar and attempted to kill his wife, Linda. After many years of appeals, his death sentence will be upheld.

TEXAS, USA — In 2015, Gabriel Hall was put on trial for killing Edwin Shaar and attacking his wife, Linda, in College Station in October 2011 while he was still a student at A&M Consolidated High School.

He was later found guilty and convicted of capital murder by a jury, later being sentenced to death by lethal injection over the alternative sentence, life in prison without parole.

On Wednesday, the Texas Court of Criminal Appeals upheld the conviction and sentencing for Hall, who is currently 30. 

Hall's case for an appeal stems from an argument made by his attorneys that a Comedy Central film crew and comedian Jeff Ross, who interviewed him while he was in custody in the Brazos County Jail, violated his constitutional rights since the footage was used during his 2015 trial, and was filmed without the permission of his lawyers. 

During the 2015 trial, Hall allegedly joked about the killing, which county prosecutors played while a sentence was being decided on.

According to the Brazos County District Attorney’s Office, the Texas Court of Criminal Appeals originally denied rehearing in the appeal in the State of Texas v. Gabriel Hall in spring 2022. 

Hall's attorney has indicated that they plan to appeal the death sentence to the U.S. Supreme Court.
