BREAKING: Gabriel Hall sentenced to death by lethal injection

BRYAN, Texas - A jury has reached a verdict in the Gabriel Hall capital murder trial. Gabriel Hall has been sentenced to death by lethal injection for the October 2011 stabbing and shooting of Edwin Shaar. His wife was also stabbed in the neck but survived.

BRYAN, Texas - Any moment now the jury could decide whether Gabriel Hall will spend the rest of his life behind bars or be sentenced to death by lethal injection. To come up with the verdict, the jury must answer at least one of two questions.

The first, is whether they think beyond a reasonable doubt that Hall would commit another act of violence thus posing a threat to society. If they answer no, he gets life in prison. If the answer to that is yes, then they must answer whether there is enough evidence to warrant life in prison without parole instead of the death penalty. What that means is that he jury can decide whether or not they think life in prison would be a suitable enough punishment. The jury began deliberating around 1PM. If they are not done by this evening, they will be escorted to a hotel for the night and then return tomorrow morning.

BRYAN, Texas - The punishment phase of Gabriel Hall trial is almost at it's end. The jury heard from the final witnesses today. Both the state and the defense rested their cases after each had the opportunity to rebuttal.

The state first called an inmate from the Brazos County Jail who refused to answer their questions which led him to receive an additional six months in jail. The state also called an employee from the district attorneys office and a psychologist, who says Hall has no mental illness. Murder victim Edwin Shaar's wife Linda and her son, who goes by the name Trey, also took the stand. The Shaars reminded the jury about the kind of man Edwin Shaar was before he was brutally murdered by Gabriel Hall.

The final witness and only witness by the defense today was a woman named Renee Slayback who Skype chatted in from Ohio. Slayback adopted two of Gabriel Halls younger biological siblings. She said she heard about what was happening to Gabriel online, talked to her children, and ended up calling the defense lawyer last night saying they needed to get a message to Gabriel. Slayback said "tell Gabriel that we do care and that Gabriel does have family here that cares for him." That testimony left multiple people in the courtroom in tears.

The jury will hear the final arguments tomorrow morning and then they will begin to deliberate.

BRYAN, Texas - Almost a month ago Gabriel Hall was convicted of capital murder. Now it's up to the jury to decide whether he will spend the rest of his life in prison or be sentenced to death by lethal injection. The defense rested it case today after hearing from their final witness. Gabriel Hall's biological sister, Eralyn, gave an emotional testimony saying she and Gabriel never felt love or affection from neither their biological nor adopted parents. Eralyn described taking care of Gabriel and his siblings while living in the slums in the Philippines..She also talked about the emotional abuse at her adopted family's home. Like many of her siblings, she recalls name calling and threats. Eralyn was one of the adopted children who got kicked out of the house. She was not there at the time when Gabriel Hall committed to murder.

While in tears she said quote. "I wish I could have been there for him. I wish I could have been there and helped him through his struggles. Through his demons. Fight his demons. I'm still fighting my demons every single night."

The state began it's rebuttal today calling a number of witnesses, including someone from the district clerks office, a psychologist, and one Hall's adopted sisters from Russia. The state will continue calling witnesses tomorrow morning. After they are done, the defense will have another opportunity to rebuttal. Jurors will likely begin deliberation on Wednesday.

BRYAN,Texas - Psychologists in the Gabriel Hall trial claims the 22-year-old experienced trauma throughout his life. A jury found Hall guilty of capital murder more than two weeks ago. The question now is whether he'll spend the rest of his life in prison or be sentenced to death by lethal injection. Today, the courtroom heard from two psychologists about what they say is the trauma Gabriel Hall experienced through out every developmental stage in his life. They described Halls life in the slums., growing up in poverty and witnessing and being abuse. They also talked about him being abandoned and eventually being adopted by the Halls, who they claim did not provide him with the emotional help he needed and even added to that trauma.

One of the psychologists, Dr. Brams said quote ""this accumulated into a young man whose brain was broken, his spirit was broken, his heart was broken, and this is how he was functioning at the age of 18 when the events occurred." The other psychologist said Hall coped with the trauma by disconnecting physically and emotionally.

The jury will continue to hear from the defense's witnesses throughout the week. The last is expected to take the stand next Monday. The final arguments before the jury deliberates should place next Tuesday.

BRYAN, Texas- Two weeks ago today, Hall was found guilty of capital murder. Now, it is up to the jury to decide his fate. Today ended the second week of the sentencing phase of the trial. A number of witnesses took the stand including a psychologist, an officer from the detention center, Hall's former gym teacher and we heard an emotional testimony from Hall's older sister Natalia McDonough.

McDounough says she did not have too much interaction with Gabriel. She did say though that she remembers him as being goofy and said she cared about him. Natalia went on to describe how she was treated by her and Hall's adopted mother, Karen Hall. She told the courtroom that when Karen was angry she would call her stupid, and threatened to send her back to Russia.

Theresa said quote: "She said 'i'm going to get plane tickets for you.' iI said 'to where?' She said back to russia" She said it like a few times."

It was an emotional testimony in front of the jury who will decide whether or not Gabriel Hall will spend the rest of his life in prison or be sentenced to death by lethal injection.

BRYAN, Texas- Just over a week ago, Gabriel Hall was found guilty of capital murder. Today, week two of his sentencing hearing begins. Many of the witnesses who took the stand were on what might be a "hit list" that Gabriel Hall had written, that included many of Hall's siblings, a classmate, fellow church goer, and the Hall's neighbor. Most of those people said they had no idea why they would be on any sort of list written by Hall. His classmate even said she was nothing but nice to him.

Two of Hall's sisters, Susan and Alex, took the stand but told very different stories about the treatment in the Hall home. Susan says she witnessed Gabriel's adopted mother, Karen, smack and kick the children in house. She told the defense that Karen said things like " if it wasn't for me you'd be a junkie or prostitute back in Russia." Alex said she never witnessed any abuse in the home and justified why many of her siblings left the hall home, either by going to boarding school or being asked to leave.

The state wrapped up today's testimony from jailers from the Brazos County Detention center who say they found razors and shanks in Halls bunk area. This phase of the trail is expected to take at least another two weeks. Gabriel Hall faces life in prison or death my lethal injection.

Before the jury met to deliberate, he state and the defense presented their closing arguments. District Attorney Jarvis Parsons told the jury that the issue is not Halls age, which at the time was 18, but his intent. He reminded them multiple times that Gabriel Hall had been planning the murder for a year and a half.

Many people KAGS HD news reporter Aleksandra Bush spoke with outside the courtroom were surprised the jury took that long to decide, especially since the defense did not have any witnesses, only asked a few questions to the states witnesses, and even said in their closing arguments to the jury "we told you we would not attempt to excuse or minimize Gabriel's actions."

According to our legal expert, the defenses real challenges are now going to be in the punishment phase.

"Make sure the jury knows exactly who this kid is, exactly what his motivations may have been and where this comes from because often times these things are rooted in what has happened to somebody in their past," says Attorney Shane Phelps.

Punishment is set to begin at 9 am on Monday. KAGS HD news reporter Aleksandra Bsuh was told there will actually be more witnesses during this phase of the trial than the last.There are even people flying in from the Philippines to take the stand.

This morning, the jury heard from a number of witnesses from the Texas Department of Public Safety Crime Lab. They presented DNA evidence that links Hall's clothing and the weapons to blood of the victims.

Linda Shaar was the final witness to take the stand in this phase of the trial. Linda described the moments that lead her to call 911 and later her own attack. She said she was sitting in her usual spot at home when she heard a ruckus. Linda said she knew someone was hurting her husband. She didn't know where the noise was coming from but knew it was serious. Linda called 911 and gave them her name and address.

When she did finally see the man, Linda Shaar said "He had a real mad look on his face. You know, bad. I said what do you want. I kept saying what do you want. If he wanted anything i'm sure we would give it to him."

The next thing she remembers is lying on the floor bleeding thinking she was going to die. She says she laid there and acted like she was dead.

After her testimony, the court adjourned. Tomorrow we will hear the closing statements before the jury begins deliberations.

Hall was arrested in October in 2011 and charged with the death of 69-year-old Edwin Shaar. Shaar was stabbed and shot in his garage. Shaar's 70-year-old wife, Linda, was also stabbed in the neck suffering serious but non-life threatening injuries.

At the time of the incident, Hall was 18 years old and still a student at A&M Consolidated High School.

Today,the jury heard from 10 witnesses including the Shaars neighbor, police who responded to the emergency, a medical examiner and some of Gabriel Halls siblings. While Hall appeared unresponsive for much of the day, our reporter in the courtroom noticed his demeanor changed during his siblings testimonies. His brother and sister told the court Hall acted normal the night of the murder.

Also in court today was Linda Shaar. Sharr chose to leave the courtroom at times to avoid seeing any crime scene photos. She is expected to take the stand later this week.

If Hall is convicted, he would face either life in prison or the death penalty.

Many people I spoke with outside the courtroom were surprised the jury took that long to decide, especially since the defense did not have any witnesses, only asked a few questions to the states witnesses, and even said in their closing arguments to the jury "we told you we would not attempt to excuse or minimize Gabriel's actions."

According to our legal expert, the defenses real challenges are now going to be in the punishment phase.

"Make sure the jury knows exactly who this kid is, exactly what his motivations may have been and where this comes from because often times these things are rooted in what has happened to somebody in their past," says Attorney Shane Phelps.

Punishment is set to begin at 9 am on Monday. KAGS HD news reporter Aleksandra Bsuh was told there will actually be more witnesses during this phase of the trial than the last.There are even people flying in from the Philippines to take the stand.

BRYAN, Texas - Gabriel Hall was in tears today after hearing Linda Shaar's testimony in court.

This morning, the jury heard from a number of witnesses from the Texas Department of Public Safety Crime Lab. They presented DNA evidence that links Hall's clothing and the weapons to blood of the victims.

Linda Shaar was the final witness to take the stand in this phase of the trial. Linda described the moments that lead her to call 911 and later her own attack. She said she was sitting in her usual spot at home when she heard a ruckus. Linda said she knew someone was hurting her husband. She didn't know where the noise was coming from but knew it was serious. Linda called 911 and gave them her name and address.

When she did finally see the man, Linda Shaar said "He had a real mad look on his face. You know, bad. I said what do you want. I kept saying what do you want. If he wanted anything i'm sure we would give it to him."

The next thing she remembers is lying on the floor bleeding thinking she was going to die. She says she laid there and acted like she was dead.

After her testimony, the court adjourned. Tomorrow we will hear the closing statements before the jury begins deliberations.

BRYAN- The Capital Murder Trial against Gabriel Hall is underway. Today, a jury pool of five men and nine women, two of whom are alternates, entered the Brazos County Courtroom to hear opening arguments. Hall officially pleaded not guilty Tuesday morning.

Hall was arrested in October in 2011 and charged with the death of 69-year-old Edwin Shaar. Shaar was stabbed and shot in his garage. Shaar's 70-year-old wife, Linda, was also stabbed in the neck suffering serious but non-life threatening injuries.

At the time of the incident, Hall was 18 years old and still a student at A&M Consolidated High School.

Today,the jury heard from 10 witnesses including the Shaars neighbor, police who responded to the emergency, a medical examiner and some of Gabriel Halls siblings. While Hall appeared unresponsive for much of the day, our reporter in the courtroom noticed his demeanor changed during his siblings testimonies. His brother and sister told the court Hall acted normal the night of the murder.

Also in court today was Linda Shaar. Sharr chose to leave the courtroom at times to avoid seeing any crime scene photos. She is expected to take the stand later this week.

If Hall is convicted, he would face either life in prison or the death penalty.

BRYAN, Texas- The jury found Gabriel Hall guilty of capital murder. That was after about four hours of deliberation which included re-listening to his confession tape.

Before the jury met to deliberate, he state and the defense presented their closing arguments. District Attorney Jarvis Parsons told the jury that the issue is not Halls age, which at the time was 18, but his intent. He reminded them multiple times that Gabriel Hall had been planning the murder for a year and a half.
