Bryan man given two-year maximum sentence in prison for committing crimes while on probation

In 2018, Gustavo Sandoval was placed on probation for five years for a guilty plea to a marijuana possession charge in a drug free zone, but disregarded the order.

BRYAN, Texas — A man that repeatedly violated the conditions of a plea deal he took in 2018 was sentenced to a maximum two years in prison, according to the Brazos County District Attorney's Office.

Gustavo Sandoval, 33, pled guilty to being in possession of 2-4 ounces of marijuana in a Drug Free Zone on Jan. 22, 2018. As a part of his plea, he was placed on probation for five years, and one of the conditions of his probation was that he would not use any alcohol or drugs or commit new crimes.

However, Sandoval disregarded the probationary conditions multiple times from 2021 to 2023. On July 21, 2021, he was stopped by a Bryan Police officer after being seen driving in the oncoming lanes on Texas Avenue, and was arrested for Driving While Intoxicated and having cocaine, marijuana, and an open container of beer in his car. A test of his blood revealed a Blood-Alcohol Concentration level of 0.13. In Texas, the legal BAC limit is 0.08.

A motion was filed by the State afterwards to revoke his probation, claiming that Sandoval had violated multiple conditions of his probation in addition to the 2021 arrest.

Despite the motion being filed by the State, Sandoval continued to violate the conditions of his probation. 
On March 6, 2022, Sandoval was found to be in possession of cocaine outside of a nightclub by police.

Nearly a year later, on Jan. 11, 2023, Sandoval was found passed out in his car at an intersection while the car was still running, and was arrested for Driving While Intoxicated, this time with a BAC level of 0.16. Additionally, like his arrest in 2021, marijuana and cocaine were found in his car after a search by officers.

Sandoval was handed his 24-month sentenced on March 21, 2024 by Judge John Brick.

"The defendant repeatedly violated the most important condition of his probation by committing new offenses, and in doing so, he put our community at risk," said Assistant District Attorneys Ryan Golden and Mark Stahman. "This sentence is warranted by his actions."
